NEW evidence has been found by supporters who want a public right of way for a footpath between Dilton Marsh and Westbury.
In June this year, Wiltshire Council refused the application to make the path known as the ‘Cinder Track’, that runs alongside the railway, into a public right of way after an application by councillor, Russell Hawker.
However, cllr Russell Hawker and cllr Francis Moreland, who have launched an appeal against the decision, have now found new evidence to show that the route has been in public use since at least 1808.
The pair say they have found 83 documents and maps at the Wiltshire and Swindon History Centre that date back to 1808, which show that some form of the route was in public use, before the railway lines were constructed.
The appeal is due to be given to the inspector in December with a decision likely to occur sometime in the New Year.
