A PUBLIC right of way claim for the footpath between Dilton Marsh and Westbury has been refused by Wiltshire Council despite county councillor Russell Hawker leading a campaign to save it.
In 2016, the White Horse News reported that residents had become concerned when the ‘cinder track’ path, which runs alongside the railway line, was found blocked by rubble and a public right of way claim was submitted in March 2017.
However, Wiltshire Council state, “The application has been refused as it is considered that whilst it may be possible that public rights could have been acquired over the southern section of the path pre-1949, that there was an insufficiency of evidence for the period to form a reasonable allegation that a public right subsisted.”
Campaigners are looking to appeal the decision by providing further information about the cinder track’s use by the public.
